Angola will have legislation to govern electronic commerce

The Ministry of Industry and Commerce (MINCOM) sent to public consultation, in the first quarter of 2022, the proposal for a regulation on the supervision of electronic commerce in the country, in order to promote the security and efficiency of the response of the infrastructures of the cyber market .

According to what was revealed by a MINCOM source, the proposal for a regulation, which could evolve into a law, results from the fact that Angola's legislation is not precise with regard to electronic commerce, and because it addresses, in a generic way, the situation of the economy digital.

The idea of ​​the ministry is to fill in the gaps that the various diplomas present, such as cybercrime, the lack of identification of the infrastructure or the seller and the guarantees, as well as the right to information on the sale of the product, which is the main objective of the preparation of that legislation.

BUT: E-commerce continues to expand in Angola

According to Osvaldo Epipi, technician in the support area of ​​the National Institute of Consumer Defense (INADEC), speaking to ANGOP, in 2007 the Commercial Activities Law (Law No. 1/07 of May 14), a diploma that makes a slight reference to electronic commerce, in terms of distance selling, and which currently, the real situation, goes beyond distance selling, taking into account the multiple services available on the most diverse online platforms.

"The Institute saw that it was necessary to create a technical group, due to the successive infractions registered on this activity”, said Osvaldo Epipi.

From what has been revealed, the proposal for the regulation on supervision of Electronic Commerce was drawn up by a multisectoral group comprising, in addition to the Ministry of Industry and Commerce (Mindcom), Finance, the Interior, the General Tax Administration (AGT) and the National Bank of Angola (BNA).

Another reason why the country has legislation for electronic commerce has to do with complaints, where this year alone there have been over 883 complaints, in the province of Luanda alone, linked to the issue of online shopping. Added to the other provinces of the country, it reaches one million 500 complaints.
